Second Public Notice
The
Pima County Department of Environmental Quality (PDEQ) proposes to revise the existing
Air Quality Permit No. 1052 to Tucson Electric Power (TEP) Irvington a.k.a. H.Wilson Sundt Generating Station (IGS) located at 3950 E. Irvington Rd. This significant permit revision amends the Class I Prevention of Significant Deterioration (PSD) permit for IGS and pertaining only to Unit 3. Unit 3 is not equipped with any pollution control device for Nitrogen Oxides (NO
x) emissions. More stringent enforceable operational restrictions on Unit 3, to reduce (NO
x) emissions, are identified in Section VI of the permit and shall become effective one year after the U.S. Environmental Protection Agency (EPA) approves the Arizona Department of Environmental Quality’s (ADEQ) Regional Haze (NO
x) Reasonable Progress determination for Unit 3 and adopts Section VI of this permit as part of the State Implementation Plan (SIP) for Arizona.
PDEQ is also proposing revisions to the
Pima County portion of the Arizona SIP. PDEQ proposes the submittal of Section VI of the proposed revised permit to U.S. EPA for approval as a source-specific revision to the Pima County portion of the Arizona SIP. The PDEQ SIP revision will be included in ADEQ’s proposed comprehensive regional haze SIP revision and will support the enforceability of ADEQ’s long-term strategy pursuant to 40 CFR 51.308(f)(2) of the federal regional haze program. The program requires States to submit a long-term strategy for addressing regional haze visibility impairment in mandatory Federal Class I areas. These Federal Class I areas are granted special air quality protections under Clean Air Act section 162(a). ADEQ will provide for public notice and comment on the proposed Arizona comprehensive regional haze SIP separately.
PDEQ is opening a 36-day public comment period today in order for the public to provide comments on the
proposed permit revision and/or
SIP revision explained above. PDEQ will host an in-person Open House on March 28, 2022 from 5:00 p.m. to 6:00 p.m. at the Abrams Public Health Center, 3950 S. Country Club Road, Tucson, in Conference Room 3102.
PDEQ will also host a Virtual Public Hearing on April 15, 2022 from 5:00 p.m. to 6:00 p.m.

The purpose of the Open House is to share information and obtain public comments on the proposed permit revision and/or SIP revision. Written comments regarding the proposed permit revision and/or SIP revision will be accepted by PDEQ during the official Public Comment Period which begins on March 14, 2022 and ends on April 18, 2022.

All written comments shall state the name and mailing address of the person, shall be signed by the person, his agent or his attorney and shall clearly set forth the reasons why the permit and/or the SIP revision should or should not be issued. Such comments and requests shall be received by PDEQ no later than 5:00 p.m. April 18, 2022. Grounds for comment on the permit are limited to this permit revision and whether the proposed permit meets the criteria for issuance prescribed in the Arizona Revised Statutes Section § 49-481 and Title 17 of the Pima County Code. Only persons who submit written comments during the official public comment period may appeal a permit decision. Comments pertaining to the source specific SIP shall pertain to the SIP revision set forth.
All data submitted by the applicant is available as part of the administrative record. The administrative record, including copies of the proposed permit, original and supplemental applications, fact sheet, and other supporting documents may be viewed between 9:00 a.m. and 4:00 p.m., Monday through Friday, at PDEQ, 33 N Stone Ave., Tucson. Most documents in the administrative record may also be obtained on-line at
PDEQ’s TEP website.
